B. HAMAS, ASSESSMENT OF THE FINDINGS OF THE UN COMMISSION OF INQUIRY INTO THE 2014 WAR ON GAZA, 29 JUNE 2015 (EXCERPTS)

On 29 June, Hamas issued a three-page document critiquing the report of the UN Human Rights Council’s commission of inquiry into Gaza (see Doc. A3). Hamas begins its statement by welcoming the commission’s “condemnation of the crimes Israel has committed against the Palestinian people,” but follows with 21 notes on its conclusions. Notably, it criticizes the commission for intervening in Palestinian political affairs and for equating Israel’s disproportionate use of force with Hamas rocket fire.

Hamas’s response was one of many critiques directed at the commission. Israel responded to the commission of inquiry with its own set of investigations, which absolved Israeli forces of any crimes alleged to have been committed during Operation Protective Edge (see Doc. C1). While Hamas concludes its statement by saying that Israel’s actions during OPE “are enough to bring the Israeli criminal leaders to the ICC,” it provides no indication of whether it would heed the commission’s main recommendation and cooperate with an ICC investigation.
