For Cattan, the principal juridical aspect which dominates the whole problem of the Middle East concerns the question: to whom does Palestine belong? In this book, he examines the question in relation to sovereignty from the standpoint of international law and in relation to ownership from the standpoint of private law.

Henry Cattan (1906-1992) joined the Palestinian Bar Association in 1932 and lectured at the Jerusalem Law School until 1942. He gave evidence before the Anglo-American Committee of Inquiry on the Palestine Question in 1946, and presented the Palestine Arab case at the second special session of the UNGA at Lake Success on behalf of the Arab Higher Committee. He was appointed by the Arab League for discussions with Count Bernadotte, the UN mediator on Palestine. He was forced into exile, and has published several books.

Né à Jérusalem, Henry Cattan (1906-1992), fut avocat et écrivain. Diplômé des Universités de Paris et de Londres, il devint par la suite avocat au barreau et conférencier à la Jerusalem Law School entre 1932 et 1942. Cattan qui a plaidé en Syrie et en Palestine, fut également membre du Palestine Law Council jusqu'en 1948. En 1946, il témoigna devant la Commission d'enquête anglo-américaine et en 1947-1948, il défendit la position palestinienne devant l'Assemblée générale de l'ONU. Cattan participa aussi aux négociations avec le comte Folke Bernadotte, le médiateur de l'ONU pour la Palestine.
